These Terms and Conditions (“Terms”) govern your access to and use of the MooPlugins website, plugins, add-ons, accounts, licence-management services, managed hosting, support, installation, customization, and other products or services we provide.

MooPlugins is a brand operated by BitKea Technologies LLP, based in Dehradun, Uttarakhand, India. In these Terms, “MooPlugins,” “we,” “us,” and “our” refer to BitKea Technologies LLP.

By accessing our website, creating an account, registering a plugin, placing an order, or using a MooPlugins product or service, you agree to these Terms.

If you are using MooPlugins on behalf of a company or organization, you represent that you have authority to accept these Terms on its behalf.

1. Our products and services

MooPlugins develops products and services for Moodle™.

Our offerings may include:

  • Free and open-source plugins;
  • Freemium plugins;
  • Paid plugins and add-ons;
  • Annual plugin or add-on licences;
  • Managed video hosting;
  • Installation and configuration services;
  • AWS infrastructure services;
  • Custom plugin development;
  • Technical support and maintenance; and
  • Other Moodle-related products or professional services.

The features, pricing, licence period, support level, limits, and renewal terms applicable to a particular offering will be described on the relevant product page, order page, proposal, invoice, or separate agreement.

2. Eligibility and accounts

You must be legally capable of entering into a binding agreement to use our paid services.

You are responsible for:

  • Providing accurate and current account information;
  • Maintaining the confidentiality of your credentials;
  • All activity occurring through your account;
  • Ensuring that authorized team members use the account appropriately; and
  • Notifying us promptly of suspected unauthorized access.

You may not create an account using false, misleading, or unauthorized information.

We may request reasonable information to verify an account, order, licence, or payment.

3. Free and open-source plugins

Some MooPlugins products are free and distributed under an open-source software licence.

Your rights to use, copy, modify, and redistribute open-source software are governed by the licence included with the applicable plugin or repository.

If these Terms conflict with the open-source licence regarding rights to the software code, the open-source licence will control for that code.

These Terms continue to apply to:

  • The MooPlugins website;
  • MooPlugins branding and trademarks;
  • Accounts and licence-management systems;
  • Managed hosting;
  • Paid services;
  • Paid add-ons;
  • Documentation not included under an open-source licence;
  • Support services; and
  • Other proprietary content or services.

Open-source availability does not mean that hosting, installation, support, customization, infrastructure, or premium add-ons are provided without charge.

4. Plugin registration and licence management

A MooPlugins plugin may require registration even when it is free or open source.

Registration may be used to:

  • Maintain plugin and licence records;
  • Manage free, freemium, and paid entitlements;
  • Provide updates or support;
  • Connect related add-ons or services;
  • Prevent unauthorized use of paid functionality; and
  • Communicate important product or security information.

Registration does not remove rights granted under the applicable open-source licence.

You must not:

  • Provide false registration information;
  • Manipulate or bypass paid-feature controls;
  • Use one paid licence for more sites than permitted;
  • Share private licence keys without authorization; or
  • Resell paid access unless expressly permitted.

Specific licence limits displayed at purchase or activation form part of these Terms.

5. Paid plugins and add-ons

Certain plugins, add-ons, features, or service packages may require payment.

A paid licence may be:

  • A one-time licence;
  • A recurring monthly licence;
  • An annual licence;
  • Limited to a specified number of sites; or
  • Subject to other conditions described at purchase.

Unless otherwise stated, a time-limited paid plugin or add-on licence provides access to the licensed functionality, updates, and the stated support level during the active licence period.

Expiry or cancellation may result in the loss of:

  • Future updates;
  • Technical support;
  • Access to paid downloads;
  • Cloud-based features;
  • Licence validation; or
  • Other paid functionality described for the product.

We will not remotely remove rights granted under an applicable open-source licence. However, premium features and services may depend on an active commercial licence.

6. Prices, orders, and taxes

Prices are displayed in the currency shown on the relevant page or invoice.

You are responsible for:

  • Reviewing the product description before ordering;
  • Providing accurate billing information;
  • Paying all applicable charges;
  • Paying applicable taxes, duties, or governmental charges unless included in the displayed price; and
  • Ensuring that the selected product or service meets your requirements.

Prices and product configurations may change for future orders or renewal periods. Changes do not retroactively affect a completed fixed-price order unless required by law or agreed with you.

We may refuse or cancel an order where:

  • Pricing or product information contains an obvious error;
  • Payment cannot be completed;
  • Fraud or unauthorized use is suspected;
  • The requested service would be unlawful or technically unsuitable; or
  • We cannot reasonably provide the requested service.

If we cancel an order after payment without providing the purchased product or service, we will refund the applicable payment.

7. Payments

Payments may be processed through Stripe or another payment provider identified during checkout.

By submitting payment information, you represent that:

  • You are authorized to use the payment method;
  • The billing information is accurate; and
  • You authorize the applicable charges.

Payment processing is also subject to the payment provider’s terms and privacy practices.

We do not directly store complete payment-card numbers.

8. Subscriptions and automatic renewal

Certain offerings, including managed hosting, paid support, maintenance plans, and future paid plugin licences, may be sold as recurring subscriptions.

Unless otherwise stated at purchase:

  • Subscriptions renew automatically for the same billing interval;
  • The applicable payment method will be charged at renewal;
  • The renewal price will be the price communicated for the next period; and
  • The subscription remains active until cancelled.

You authorize us and our payment provider to collect recurring charges until the subscription is cancelled.

We may provide renewal reminders where required by law or stated as part of the service, but you remain responsible for managing your subscription.

9. Cancelling a subscription

You may cancel a subscription through the available account or billing controls or by contacting us.

Unless otherwise stated:

  • Cancellation prevents the next renewal;
  • Cancellation does not immediately terminate an already-paid service period;
  • The service remains available until the end of the current billing period;
  • No further recurring payment will be collected after an effective cancellation; and
  • Amounts already paid are handled according to our Refund Policy.

You should cancel before the renewal date to avoid the next charge.

10. Managed video hosting

MooPlugins managed video hosting provides storage, processing, transcoding, and delivery services for video files used with compatible MooPlugins products.

Your plan may include limits relating to:

  • Storage;
  • Bandwidth;
  • Processing or transcoding;
  • File size;
  • Supported formats;
  • Fair use; and
  • Other technical resources.

You agree not to exceed or attempt to bypass plan limits.

We may ask you to upgrade, reduce usage, or pay applicable overage charges where those terms are disclosed for your plan.

10.1. Scope of hosting access

When you use managed video hosting, MooPlugins processes uploaded video files and the technical metadata necessary to provide the hosting service.

Managed hosting does not, by itself, give MooPlugins access to:

  • Your Moodle courses;
  • Student accounts;
  • Enrolments;
  • Grades;
  • Completion records; or
  • Other Moodle user data.

Student-level completion and engagement records ordinarily remain within your Moodle site.

10.2. Your video content

You retain ownership of video files and other content you upload.

You grant MooPlugins a limited, non-exclusive right to store, copy, transcode, process, transmit, and deliver the content only as necessary to provide, secure, and maintain the hosting service.

You represent that:

  • You own the content or have permission to use it;
  • Its storage and delivery do not infringe intellectual-property or privacy rights;
  • You have obtained any required permissions from individuals appearing in the content; and
  • The content complies with applicable law.

10.3. Cancellation and deletion of hosted videos

When a hosting subscription is cancelled, service remains active until the end of the paid billing period.

Unless a different period is specified for your plan or agreement, hosted video files may be retained for up to 30 days after the service ends.

After that period:

  • Files may be permanently deleted from active systems;
  • Files may no longer be recoverable;
  • Related backups may remain temporarily until overwritten through the normal backup cycle; and
  • MooPlugins is not obligated to continue storing or restoring the files.

You are responsible for downloading or transferring any files you wish to retain before the retention period ends.

Non-payment, abuse, unlawful content, or a material security risk may result in earlier suspension. Where reasonably possible, we will provide notice before permanent deletion unless prohibited by law or immediate action is necessary.

11. Installation, setup, and professional services

Installation, AWS setup, customization, development, migration, and consulting services may be governed by:

  • A proposal;
  • Statement of work;
  • Order description;
  • Invoice;
  • Email agreement; or
  • Other written service terms.

You are responsible for:

  • Providing timely access and information;
  • Maintaining appropriate backups;
  • Ensuring that you are authorized to provide access;
  • Reviewing and testing deliverables; and
  • Communicating requirements accurately.

Delays caused by unavailable access, incomplete information, third-party systems, or changed requirements may affect delivery and cost.

Unless expressly agreed otherwise, custom work does not include indefinite maintenance, future Moodle-version compatibility, or support for later third-party changes.

12. Support and updates

Support availability depends on the applicable product or plan.

Free community support, where offered, may be provided without guaranteed response or resolution times.

Paid support may be limited by:

  • Licence period;
  • Support plan;
  • Number of supported sites;
  • Covered products;
  • Support hours;
  • Fair-use limits; and
  • Scope stated at purchase.

Support may not include:

  • Unrelated Moodle problems;
  • Third-party plugin conflicts;
  • Server administration;
  • Custom development;
  • Unsupported product versions;
  • Problems caused by unauthorized modifications; or
  • Issues outside the purchased service scope.

We aim to provide helpful support but do not guarantee that every issue can be resolved or that a particular response will satisfy every customer.

13. Compatibility and customer testing

We may identify supported Moodle, PHP, database, browser, or infrastructure versions for each product.

You are responsible for checking compatibility before using a plugin in production.

Software environments vary. You should:

  • Maintain current backups;
  • Test installations and updates in a staging environment;
  • Review release notes;
  • Follow installation instructions; and
  • Verify compatibility with your theme, customizations, and other plugins.

A plugin described as compatible with a particular Moodle version is not guaranteed to work with every third-party customization or server configuration.

14. Updates and product changes

We may release updates that:

  • Fix errors;
  • Improve security;
  • Add or remove features;
  • Change compatibility;
  • Update third-party dependencies; or
  • Modify technical requirements.

We may change, discontinue, or replace a product or feature where reasonably necessary.

For paid services, we will use reasonable efforts to avoid materially reducing the core purchased service during an active fixed billing period, except where changes are necessary for security, law, third-party dependencies, or technical stability.

15. Third-party services

MooPlugins products may interact with third-party services such as:

  • Moodle;
  • Amazon Web Services;
  • Stripe;
  • GitHub;
  • Browsers;
  • Operating systems;
  • Hosting providers; and
  • Other plugins or infrastructure components.

We do not control third-party products or services.

Their availability, pricing, functionality, security, and policies may change independently. MooPlugins is not responsible for failures caused by a third-party service outside our reasonable control.

You are responsible for complying with applicable third-party terms.

16. Website and proprietary content

Except for material expressly released under an open-source or other separate licence, the MooPlugins website and its content—including branding, logos, graphics, layouts, documentation, written material, and original design elements—are owned by or licensed to BitKea Technologies LLP.

You may view and use website content for your internal evaluation and legitimate use of MooPlugins products.

You may not, without permission:

  • Republish substantial website content;
  • Misrepresent MooPlugins content as your own;
  • Use MooPlugins branding in a misleading manner;
  • Sell or commercially exploit proprietary documentation;
  • Remove copyright or proprietary notices; or
  • Imply sponsorship, affiliation, or endorsement that does not exist.

17. Acceptable use

You must not use our website, products, accounts, hosting, or services to:

  • Violate applicable law;
  • Infringe intellectual-property, privacy, publicity, or other rights;
  • Upload malware or harmful code;
  • Gain unauthorized access to systems or accounts;
  • Interfere with service operation;
  • Circumvent paid-feature, licence, usage, or security controls;
  • Send spam or abusive communications;
  • Host unlawful, fraudulent, deceptive, or harmful material;
  • Conduct security testing without written authorization;
  • Impersonate another person or organization;
  • Use stolen or unauthorized payment information; or
  • Resell a service where resale is not permitted.

We may investigate suspected violations and take reasonable protective action.

18. Suspension and termination

We may suspend or terminate access where:

  • Payment is overdue;
  • These Terms are materially breached;
  • Fraud, abuse, or unlawful conduct is suspected;
  • A security risk exists;
  • Continued service could damage our systems or third parties;
  • A legal or regulatory requirement applies; or
  • A third-party dependency required for the service becomes unavailable.

Where reasonably possible, we will provide notice and an opportunity to resolve the issue.

Immediate action may be taken where necessary to address fraud, unlawful content, urgent security risks, or harm to other users.

Termination does not remove payment obligations that arose before termination.

19. Refunds

Refunds are governed by the MooPlugins Refund Policy.

Nothing in these Terms limits any mandatory refund or consumer right that cannot lawfully be excluded.

20. Service availability

We aim to maintain reliable services, but uninterrupted operation cannot be guaranteed.

Services may be affected by:

  • Maintenance;
  • Updates;
  • Security incidents;
  • Internet or infrastructure failures;
  • Third-party outages;
  • Force majeure events; or
  • Circumstances outside our reasonable control.

Unless a separate service-level agreement expressly applies, we do not guarantee a particular uptime percentage, response time, or recovery time.

21. Disclaimer of warranties

To the fullest extent permitted by law, the website, free plugins, open-source software, and services are provided on an “as available” and, where applicable, “as is” basis.

We do not warrant that:

  • Every product will meet every requirement;
  • Operation will always be uninterrupted or error-free;
  • Every defect can be corrected;
  • A plugin will be compatible with every environment;
  • Third-party services will remain available; or
  • Use of a product will produce a particular business, educational, compliance, or financial outcome.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

22. Limitation of liability

To the fullest extent permitted by applicable law, MooPlugins and BitKea Technologies LLP will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, including loss of profits, revenue, goodwill, anticipated savings, business opportunity, or data.

Our total aggregate liability arising from a paid product or service will not exceed the amount you paid for the product or service giving rise to the claim during the 12 months immediately preceding the event giving rise to liability.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability arising from fraud or other matters where exclusion is prohibited by law.

You are responsible for maintaining appropriate backups and business-continuity procedures.

23. Indemnity

To the extent permitted by law, you agree to indemnify BitKea Technologies LLP against third-party claims, losses, and reasonable expenses arising from:

  • Content you upload;
  • Your unlawful or unauthorized use of a service;
  • Your infringement of another person’s rights;
  • Your breach of these Terms; or
  • False representations made by you.

This provision does not require you to indemnify us for losses caused by our own unlawful conduct.

24. Privacy

Our collection and use of personal information are described in the MooPlugins Privacy Policy.

The Privacy Policy forms part of the terms governing your interaction with our website and services.

25. Governing law and jurisdiction

These Terms are governed by the laws of India.

Subject to any mandatory consumer-protection or jurisdictional rights that apply to you, the courts located in Dehradun, Uttarakhand, India will have exclusive jurisdiction over disputes arising from these Terms or MooPlugins services.

Before beginning formal proceedings, the parties should make reasonable efforts to resolve the dispute through good-faith communication.

26. Changes to these Terms

We may update these Terms to reflect changes in:

  • Products or services;
  • Commercial practices;
  • Technical requirements;
  • Legal obligations; or
  • Security requirements.

The updated Terms will be posted with a revised “Last updated” date.

Material changes affecting an active paid subscription may also be communicated through email, account notification, or another reasonable method.

Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

27. General provisions

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Failure to enforce a provision does not waive our right to enforce it later.

You may not transfer a paid account or agreement without our permission. We may transfer our rights and obligations as part of a business restructuring, merger, acquisition, or sale.

These Terms, together with applicable product terms, order details, proposals, policies, and written agreements, constitute the agreement between you and MooPlugins regarding the relevant service.

Where a signed agreement or product-specific term expressly conflicts with these general Terms, the more specific agreement will control for that matter.

Moodle™ is a registered trademark of Moodle Pty Ltd.
